Campus Concert Contest Rules

106.5 THE END/”SCHOOL SPIRIT CONTEST”

These contest rules are specific to the above contest conducted by Entercom California, LLC d/b/a KUDL-FM (collectively, the “Station”).  Except to the extent specifically set forth below with respect to this specific contest, the Station’s general contest rules apply to this contest as well.  A copy of these specific contest rules and the Station’s general contest rules are available at the Station’s studio at 5345 Madison Avenue Sacramento, CA 95841 during regular business hours and on the contest page on the Station’s website at www.endonline.com. To the extent that the general contest rules differ from these rules, these rules will govern and control with respect to this Contest.

How to Enter

No purchase necessary to enter or win. 

The winning school will be determined by the cumulative total of entries received for a particular school at the conclusion of the Contest.  To enter go to www.endonline.com to receive the special keyword for your school.  Students, faculty, employees, administrators and alumni as well as friends and family members of all above mentioned individuals or any member of the general public may find a list of high school codes listed on Attachment B (“Participating Schools”) at Endonline.com.  Participants will have to text in the keyword to short code 73389 to VOTE.  The keyword must be combined as one “word” when texting to the short code to be counted as an entry for a particular school.  Entry is open for each keyword from September 11, 2017 at 6:30am (PST) until September 25, 2017 at 2:00pm (PST).  WARNING:  Online listeners to streamed broadcasts may experience a lag in transmissions due to buffering limitations.  Contest Participants should not rely on streamed broadcasts.

Beginning on Monday, September 11th at 7am (PST), participants may visit the School Spirit contest page on www.endonline.com, by clicking on the flipper for this contest or by going to the Stations’ contest page) to obtain the keyword unique to their high school necessary for entering this contest. A list of the codes is also attached to the end of these rules as Attachment B.

Despite the designation of a “Participating School” as a defined term above, no school has been contacted nor has agreed to participate in this contest.  Station has not contacted any of the Participating Schools to confirm whether or not they would be willing to accept the prize in this contest should their school win.  IT IS THE SOLE RESPONSIBILITY OF ALL TEXTERS TO CHECK IN ADVANCE WITH THE SCHOOL ADMINISTRATOR TO DETERMINE WHETHER OR NOT THE PARTICIPATING SCHOOL INTENDS TO ACCEPT THE PRIZE IN THE EVENT OF WINNING.   In the event that an authorized representative of any school listed as a Participating School contacts KUDL prior to the completion of this contest and requests that KUDL remove them from participation in this Contest, these contest rules and any associated list and webpage will be updated as promptly as is reasonably practical by Station to eliminate that school’s name and participation in this contest and any text/vote for that school shall be forfeited and disqualified from this contest (and will not be allocated to any other Participating School).

All text entries will be accepted, notwithstanding the entrant’s legal status, state of residency or age.

Station will use good faith efforts to attempt to match up the texted keyword with the name of a Participating School.  However, Station is not responsible for any failure to identify or misidentification of a text (including, without limitation, due to texter typos).  Station reserves the right (in its sole discretion) to exclude any and all text votes that it determines (in Station’s sole discretion) does not appear to match up with any Participating School. 

There is no limit to the number of text entries any person or telephone may submit.  However, use of robotic, automatic, programmed or similar modes of sending texts may be prohibited by Station if Station determines (in its sole discretion) that some or all of such modes are adversely affecting the contest in any way (as determined by Station in its sole discretion) and, in such case, any suspicion by Station (whether accurate or not) may result in entrant or Participating School being disqualified from any further participation or winning in this contest, in Station’s sole discretion .        

Entrants acknowledge that text messages are distributed via third party mobile network providers and, therefore, Station cannot control certain factors relating to message delivery.  Entrants acknowledge that, depending on the recipient’s mobile provider service, it may not be possible to transmit or receive a message to the recipient successfully. Station does not claim or guarantee availability or performance of this service, including liability for transmission delays or message failures.  Station does not charge a fee for this service. It is each entrant’s responsibility to check with their individual telephone carrier, as other charges may apply.  Station assumes no responsibility for charges incurred for text-messaging or for charges incurred for any bounce-back message sent by Station.  Station is not responsible for any text messages that are misdirected, lost, stolen, disconnected, not received, or are illegible. The Station is not responsible for any telephone transmission errors. 

How to Win

The high school that received the most text entries after combining the entry totals at the conclusion of the Contest will be declared the Grand Prize Winner, subject to verification of eligibility and compliance with these Contest rules.  In the event of a tie among two (2) or more schools, a random drawing will occur on Monday, September 25, 2017 at approximately 3:00pm (PST) among the tied schools and ONE will be declared the Grand Prize Winner, subject to verification of eligibility and compliance with these Contest rules. A Station representative will contact the potentially winning Participating School via phone by NOON on Tuesday September 26, 2017, explain the prize to the Principal or other administrator in charge, and determine if the school is willing to accept the prize.  If the school rejects the prize or fails to respond or satisfy any deadline set by the Station, Station will have the right to immediately disqualify that school and, time permitting, recognize the Participating School that received the next highest total of entries as the Grand Prize Winner (random drawing in the event of any tie) if that school is willing to accept the prize as the Grand Prize Winning School.  This process will continue until a winning school is declared.  However, if Station does not have a confirmed Grand Prize Winning School by 5pm on Wednesday, September 27, 2017 for any reason (including, without limitation, failure to provide any information required by Station), Station reserves the right, in its sole discretion, not to award the grand prize at all.  The station will only announce the Grand Prize winning Participating School on-air, once and if a school is confirmed and any such announcement will happen no later than Thursday, September 28, 2017 by approximately 4PM. 

Prize(s)

Only one (1) Grand Prize will be awarded.  The verified Grand Prize winning school will be eligible to receive a concert performance by national recording artist “Why Don’t We” courtesy of Atlantic Records subject to acceptance of the concert by the principal of the school and the availability of the artists (the “Grand Prize”).  If the principal refuses to accept the Grand Prize on or before September 27th, 2017 as set forth in Section 11 below, then the Grand Prize will be forfeited and no substitute prize will be awarded to that school and the prize may be re-awarded (in Station’s sole discretion). 

The Principal or other authorized school board or administrator will be required to sign a release agreement in the form attached hereto as Attachment A as a condition of being awarded the Grand Prize and must return the  original to Station on September 28, 2017 (or such alternative date as determined by Station for an alternate winning school, if applicable).  Winning school shall provide Station with a copy of its tax ID form and any other documentation Station requires as determined in its sole discretion as a condition of accepting the Grand Prize. The School representatives signing the release agreement may be asked to provide proof of authority at the request of the Station prior to the awarding of any prize.  No school will be deemed a winner in this contest until the foregoing has been completed in a timely manner. 

The winning school shall be responsible to provide an adequate location/venue, like the school’s auditorium, to host the concert and shall be responsible for any associated costs in hosting the concert.  Station may, but is not required to, hold the concert at another suitable venue it selects in its sole discretion.  The performance will occur on October 3, 2017 at a time to be mutually agreed upon by the artist(s) and school. In the event that there is no mutually agreeable time for the concert or the school is unable to accommodate the date, then the concert shall be forfeited by the school and no substitute prize shall be awarded to that school. 

Concert performance provided by Atlantic Records.  Value of the Grand Prize depends on stage, theater and/or equipment available at the winning school, but in no event shall the value of the Grand Prize exceed $5,000.

The performance will include the provision of artist performance and sound needs only.  Winning school is responsible for providing use of school’s on-campus auditorium with stage and potential stage lighting for performance.  The Grand Prize is contingent upon the artist appearing and any other third party allowing the concert to occur, which is beyond the Station’s control. Station and its sponsors are not responsible if the artist or third party determines this is not allowable for any reason. In the event of illness, act of god, scheduling conflicts or any other reason beyond Station’s control, Station will attempt to reschedule a make-up concert with the artist and if the artist are unavailable then Station will reschedule the make-up concert with an alternate artist that the Station will select in its sole discretion.  The make-up performance will occur on a date to be mutually agreed upon by the artist and school.  In the event that there is no mutually agreeable date for the make-up concert, then the make-up concert shall be forfeited by the school and no substitute prize shall be awarded to that school and there will be no Grand Prize Winner in this Contest and no Grand Prize will be awarded.

The Grand Prize Winning School’s Principal, Director, and/or Administrator has sole responsibility to determine, which members of its faculty, staff and student body may or may not attend the performance.  PERSONS WHO TEXT ON BEHALF OF THE WINNING SCHOOL ARE NOT WINNERS IN THIS CONTEST AND ARE NOT ENTITLED TO ATTEND THE CONCERT.  THE ONLY WINNER IN THIS CONTEST IS THE SPECIFIC SCHOOL THAT IS AWARDED THE PRIZE.

Notwithstanding anything to the contrary herein or stated on air, no school will be entitled to receive any prize until after their eligibility had been confirmed or accepted by Station and all required paperwork (including, without limitation, liability release agreements) requested by Station have been executed by the appropriate authorized school officials by the deadline required by Station or these contest rules.

Other Rules Specific to This Contest

     19. The eligibility requirements set forth in the general contest rules for individual persons shall not apply for 

           sending a text this Contest.  Station will accept text entries from any person regardless of their age, residency,    

           or even if they have ever won a past Station contest.
